- Keyboard Navigation Profile (Motor-Impaired): this profile enables motor-impaired persons to operate the website using the keyboard Tab, Shift+Tab, and the Enter keys. Terms of Service
This Agreement is between Bush Industries, Inc. (the “Corporation,” “we” or “our”), whose office is at 1 Mason Dr, Jamestown, NY 14701, United States; and YOU (the “Customer,” “you” or “your”), who have made a purchase on the Corporation’s website (the “Website”).
Article 1. General Conditions of Sale.
- Customer Contact Information. The Customer’s contact information is the information you provided in the registration form. This contact information also appears in the order confirmation email (the “Order summary”).
- Corporation Contact Information. The Corporation’s contact information is as follows:

Email address: websales@esolutionsfurniture.com - Object of Agreement. Under this Purchase Distance Contract (the “Agreement”), the Customer purchases the products listed in the Order summary.
- Consideration. The sales price is the price indicated in the Order summary and is due at the end of this Agreement.
Our Website uses Shopify’s electronic commerce solutions to process online orders. You must provide your payment information when making a transaction on our Website, in which case you shall be subject to Shopify’s Terms of Service. Shopify accepts the following payment methods: PayPal, Visa, Mastercard, American Express and Apple Pay. - Date. This Agreement is formed on the time and date on which the Order summary and this Agreement are sent to the email address provided upon registration. Such confirmation email also includes the expected delivery date and the location where the order will be delivered.
- Delivery Charges. Shipping and handling fees, if applicable, are indicated in the Order summary (including applicable taxes).
- Credit Cards and Order Confirmation. In order to purchase products on our Website, you must at times provide information, which includes but is not limited to credit card information used for payment and billing. By making a purchase, you agree to pay all costs incurred by yourself or by the credit card user in respect of the order placed. The Customer agrees to comply with the terms and conditions of this Agreement when making a transaction on the Website.
- Restrictions and Other Obligations of the Customer. The purchase of products on the Website is subject to the following restrictions and obligations: (i) The Corporation reserves the right to refuse an order on any reasonable grounds; (ii) If products purchased by the Customer are resold to a third party, then the Customer entirely discharges the Corporation of all liabilities arising from the assembly, disassembly or any other handling by the Customer or by a third party of the products. (iii) You accept and agree to be bound by the Website’s PRIVACY POLICY and the Corporation’s SHIPPING AND RETURN POLICIES and WARRANTY for its products. By accepting this Agreement, you confirm that you have read and accepted these policies.
- Safety. Some products offered on our Website have inherent security risks if they are not installed or handled properly. The Customer undertakes to be cautious when assembling, installing and handling products sold by the Corporation. The Customer also agrees and undertakes to read all necessary documentation for user safety regarding product assembly, installation and usage.
- Modifications. The prices posted on the Website are subject to change without notice. The Corporation reserves the right to correct all errors in the prices posted on the Website. The Customer therefore declares that he or she is aware of the prices posted on the Website when entering this Agreement.
- Cancellations. The Customer may cancel an order placed on the Website as long as the order has not been shipped. To cancel an order, the Customer must refer to the SHIPPING AND RETURN POLICIES. If the order has been shipped (including if the order is in transit), then the Customer must refer to the Returns section below.
- Returns and Final Sale Policy. All sales are final. All items offered for sale on our Websites (USA and Canada) are sold “AS-IS, WHERE-IS,” without any representation, warranty, or guarantee of any kind, whether express, implied, or statutory. No returns, refunds, cancellations after shipment, or exchanges will be permitted under any circumstances, except as otherwise required by applicable law. If, for any reason, the order’s Delivery is delayed because the shipping address was entered incorrectly or was incomplete, then the order will be returned to the Corporation and the Customer will not be eligible for a full refund Shipping and product return fees are applicable. - Product Damage or Error of Content. All products are carefully inspected and packaged before leaving the Corporation’s warehouse. While all sales are final, the Corporation will assist Customers with products that are damaged in transit or shipped incorrectly, provided the issue is reported within seven (7) days of delivery. To report an issue, Customers may contact Customer Care at 1-800-950-4782 or email websales@esolutionsfurniture.com with the following information:
(i) the order number;
(ii) a description of the issue;
(iii) photographs of the damaged, defective, or incorrect item; and
(iv) the shipping address.The Corporation will review the request and determine the appropriate resolution based on available inventory. Any replacement items offered are subject to inventory availability while supplies last. No returns, refunds, or exchanges will be permitted except as otherwise required by applicable law. - Limitations of Warranty. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE CORPORATION MAKES NO REPRESENTATION OF ANY SORT WHATSOEVER AND DOES NOT OFFER ANY WARRANTY, WHETHER EXPRESSED OR IMPLIED, OF MERCHANTABILITY, PRODUCT COLOURS, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE.
Article 2. Product Delivery.
a) Terms and Conditions of Delivery. The shipping of orders is done in the contiguous United States and Canada. The Corporation does not ship to Alaska, Hawaii or Puerto Rico. The Corporation does not ship to PO boxes, APO or FPO addresses, on islands, in remote areas or internationally. The Corporation chooses among the following carrier companies for shipping: YRC Freight, Groupe Robert, Fastfrate or FedEx (the “Carrier”).
The Customer should expect a two-day delay before the Carrier posts the tracking number on its website. The tracking number can be found in the shipping confirmation email. Please note that some orders may require multiple instalment deliveries.
b) Location. The Carrier will deliver the order in front of the location (e.g. in front of the building) specified by the Customer in the Order summary during the time slot chosen by the Customer from the times suggested by the Corporation (the “Delivery”). The Customer agrees to be present at the specified location and during the time slot chosen for Delivery in order to receive the package in person. For large-scale orders, the Corporation recommends that at least two (2) people are present at the time of Delivery to carry the boxes inside.
The Customer may be asked to provide his or her telephone number in order for the Carrier to contact the Customer to schedule the Delivery. Except for FedEx, the Carrier will contact the Customer by telephone to schedule the Delivery.
c) Customer Absence. If the Customer is absent at the time of Delivery, he or she must refer to the SHIPPING AND RETURN POLICIES. The Customer may be required to pick up his or her order at the Carrier’s warehouse or pay additional fees for a second Delivery.
d) Address Errors. The Corporation is not liable for orders that could not be delivered or that were not received because the recipient’s address was not filled in accurately by the Customer.
Article 3. Technical Conditions to Access the Website.
The Website’s digital content is accessible through recent versions of the following web browsers: Safari, Google Chrome, Firefox, and Windows Internet Explorer 11. In order for the Customer to have an optimal buying experience, the Corporation recommends using web browsers that comply with the most recent web standards. Whereas these browsers may be subject to various technological changes, the Corporation cannot guarantee that these browsers will be compatible with the Website at all times. In the event of any discrepancy or inconsistency between the Customer’s web browser and the Website, the Corporation shall not be held liable for service interruptions associated with these technological changes.
If you have technical difficulties, you may contact the Corporation at the following email address: websales@esolutionsfurniture.com. However, the Corporation does not make any guarantee or has no obligation in any way to solve the Customer’s computer software of hardware problems.
Article 4. Secured Information.
The exchange of personal and confidential information (passwords, addresses, etc.) between the Website and the Customer’s browser is protected by data encryption technology (Secure Socket Layer [SSL]) and the data stored is protected by AES-256 encryption. In addition, Shopify, the platform used by the Corporation, complies with PCI DSS standards. The Corporation uses its best efforts to ensure that personal and confidential information exchanged between the Customer and the Website is not intercepted or altered fraudulently.
Article 5. Copyright Protection.
The Website’s digital content as well as all reproduced elements (texts, comments, illustrations, logos and iconographic documents) are subject to copyright within the meaning of the Canadian Copyright Act. The Corporation reserves the right to take any necessary action in the case of a violation of these copyrights, and any such violation by the Customer will also be considered a violation of this Agreement.
Where applicable, the Customer agrees to keep confidential all information provided by the Corporation for the purpose of accessing the Website (password and username) and not disclose this information in any form whatsoever to a third party.
Article 6. Limitation of Liability.
The Corporation shall never be liable for any losses or any indirect, punitive, consequential, special or other damages arising from for the characteristics and limitations of your Internet network, in particular interrupted access to the Website, technical performance or response times to view the Website’s digital content.
Due to the Internet’s intrinsic characteristics, the Corporation does not offer any guarantee against the potential risks of diversion, intrusion, contamination or piracy of your data, files and programs. In addition, you must take all appropriate measures to protect his or her data, files and programs, including the protection against computer viruses.
For the period during which the products are under the control of the Corporation, which period starts with the manufacture and ends when the products are taken over by the Carrier for their initial Delivery, any product breakage that is beyond the control of the Corporation or for which reasonable preventive measures were taken will be deemed to be the result of a force majeure of which the Company cannot be held liable.
IN THE EVENT OF THE CORPORATION’S BREACH OF ITS OBLIGATIONS UNDER THIS AGREEMENT, TOTAL LIABILITY TO THE CUSTOMER FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) SHALL NEVER EXCEED THE AMOUNT PAID BY THE CUSTOMER TO THE CORPORATION FOR THE PRODUCTS BEING CLAIMED. THIS LIMITATION OF LIABILITY DOES NOT APPLY IF THERE IS EVIDENCE OF GROSS NEGLIGENCE OR WILFUL MISCONDUCT, OR IF THIS LIMITATION IS CONTRARY TO PUBLIC ORDER.
Article 7. Jurisdiction.
This Agreement is governed by the laws and regulations applicable in the Province of New York and the federal laws of the United States of America applicable therein. Any dispute between the parties arising from this Agreement will be subject to the exclusive jurisdiction of the courts of the Province of New York.
Article 8. Severability.
If all or part of any section, paragraph or provision of this Agreement is held invalid or unenforceable, it shall not have any effect whatsoever on any other section, paragraph or provision of this Agreement, nor on the remainder of the said section, paragraph or provision, unless otherwise expressly provided for in this Agreement.
Before entering into this agreement, the customer agrees that he or she has reviewed the agreement and has not detected any errors that need to be corrected. the customer further acknowledges that he or she was expressly given the opportunity to accept or decline this proposal. by making purchases on our website, the customer declares that he or she accepts this agreement.
The customer declares that he or she is of legal age to enter a contract in the jurisdiction where he or she resides.

By consenting to Bush Home’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Bush Home through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.
You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with Bush Home.
We do not charge for the SMS/text messaging service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. We may modify or cancel the SMS/text messaging service without notice.
You may opt out of the Service at any time. Reply with STOP to any mobile message sent from us to cancel. You will receive a one-time opt out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. For support or assistance, text HELP or email consumerservice@esolutionsfurniture.com.
The wireless carriers supported by the SMS/text messaging service are not liable for delayed or undelivered messages. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS/text messaging service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS/text messaging service.
5. SHARING YOUR INFORMATION WITH OTHER COMPANIES
We will not share your Personal Information outside Bush except in the following limited circumstances, which you consent to:

The California Transparency in Supply Chains Act of 2010 (SB 657)
The California Transparency in Supply Chains Act of 2010 (SB 657) is designed to increase the amount of information made available by manufacturers and retailers regarding efforts to address the issue of slavery and human trafficking.
Bush believes that workers at its suppliers’ facilities have the right to freely choose employment. Bush further expects that all suppliers who do business with Bush and its subsidiaries will comply with all applicable laws, including the laws against forced or involuntary labor. This expectation is embodied in the Bush Social Responsibility policy. Specifically, the Inclusiveness Section of the Social Responsibility policy requires all Bush employees to comply with all applicable laws, including civil rights, human rights and labor laws around the world. A copy of the Bush Social Responsibility Policy is located in the Social Responsibility article.
Bush is not aware of any of its suppliers engaging in human trafficking or slavery. Accordingly, Bush does not audit its suppliers for compliance with or require suppliers to certify compliance with the laws regarding human trafficking and slavery, verify its supply chains to evaluate the risks of human trafficking or slavery, provide training relating thereto, or maintain internal accountability standards relating thereto. Bush does, however, do site visits at certain suppliers prior to engaging in business with such suppliers. If Bush were to become aware of a supplier engaging in human trafficking or slavery, it would take immediate and thorough steps to ensure that such supplier was removed from Bush’s supply chain.

Corporate Ethics
The term “business gifts” refers to business entertainment, as well as gift items. The giving or receiving of appropriate business gifts is a customary way to strengthen business relationships and, with restriction, is a lawful business practice. You must exercise good judgment and moderation in order to avoid misinterpretation and any resulting adverse effect on the reputation of the Company or its employees. You must never offer, give, solicit, or receive any form of bribe. It is important that all relationships with suppliers, customers, and other parties be based on lawful, efficient and fair business practices. Bush employees may not accept gifts, favors, entertainment or other inducements from any person or organization that does or seeks to do business with, or is a competitor of the Company, if doing so would violate Company policy or interests. Any gifts which we receive must be reasonable in cost, quantity and frequency. You should never accept a gift of cash or cash equivalent. Entertainment, tickets, small gifts, promotional items, and other incidental benefits may be accepted if the purpose is to hold bona fide business discussions or to foster better accommodations. Circumstances include, but are not limited to the following:
- They are consistent with acceptable business customs and practices
- They are of reasonable value and not given or received on a repetitive basis
- They are for a Company business purpose
- They are not illegal
- We do not solicit them
- They will not cause and would not reasonably be perceived to cause us to alter normal business judgment concerning any transaction carried out on behalf of the Company
- They would not be an embarrassment to the Company or to us as Bush employees if publicly disclosed
Bush requires employees to report any business gift, favor, or entertainment (other than business meals) given or received, that has a value of $100 USD. Business and/or entertainment events sponsored by Bush must receive advance approval of the office of the CEO where expenditures will exceed $1,000 USD. Further guidance may be obtained by consulting the Bush Travel and Entertainment Policy. As a general rule, when in doubt, do not accept, give, or expense gifts or entertainment. Consult with Human Resources if you have any doubt about the propriety of a gift or entertainment.

At Bush, we have worked hard over the past several years to achieve a safe workplace and the type of safety record we can be proud of. Having a safe workplace is one of the most important benefits we offer to our employees and their loved ones. We are committed to ensuring a safe working environment for everyone. - Requiring every location to have an active safety program that is strongly supported by its management team.

All Bush facilities worldwide must maintain a professional and harassment-free working environment. They are places where employees should act with respect for one another and for those with whom we do business. The following behavior is expressly prohibited:
- Unwelcome conduct – whether verbal, physical, or visual – that is based on a person’s protected status, such as race, religion, gender, age, national origin, citizenship status, disability, sexual orientation, former military status or any other protected status.
- Abusive language, physical behavior that deliberately causes injury to another or any disorderly conduct or malicious disturbance. This includes intimidation or harassment of others.
- Sexual Harassment – this includes unwelcome sexual advances, requests for sexual favors, as well as other physical, verbal, or visual conduct based on sex when submission to the conduct is an explicit or implicit term or condition of employment or advancement or when the conduct has the purpose or effect of unreasonably interfering with the individual’s work performance by creating a hostile, offensive, or intimidating working environment.
Sexual harassment is conduct based upon sex, whether directed toward a person of the same or opposite sex. In addition to covering all employees, Bush’s harassment-free workplace policy extends to outside vendors, customers, professionals, and other providers of goods or services to any Bush location worldwide. Note that this policy applies to both work-related settings and company-organized activities outside of the workplace.
